1 Overview
1.1 The Trial License allows you to test, evaluate and present potential uses to clients.
2 Definitions
2.1 Author — Setup Type, the trading brand of Ondrej Jób, MA.
2.2 Licensee — An individual or a corporation who has the permission to use the Fonts, specified during the checkout process and denoted on the Sales Receipt.
2.3 Fonts — Software files containing digital typeface, in type and amount specified on the Sales Receipt.
2.4 License — The License grants the Licensee the right to use the Fonts and specifies the terms and conditions of the use. The License is a legally binding agreement between the Author and the Licensee.
2.5 Sales Receipt — The electronic or physical document containing information about type and scope of the License.
2.6 Computer — A device in Designer’s ownership on which the Fonts will be installed and used. The Computer may be connected to any number of output devices (e.g. a printer).
3 Provisions
3.1 This is a legal agreement between Author and Licensee. By downloading, installing, and using of the Fonts specified on the Sales Receipt, the Licensee confirms that they have read, understand, and agree to the following terms.
3.2 If the Licensee is a parent subject licensing the Fonts for subsidiaries in Licensee’s full or partial ownership, or individuals or teams under Licensee’s supervision, the Licensee must ensure they comply with the following terms.
4 Grant of License
4.1 Author grants Licensee a limited, non-exclusive, non-transferable, worldwide, revocable License to install and use the Fonts on a Computer of a single (1) Designer.
4.2 Licensee may license other Fonts for more Designers or for commercial use by purchasing an additional license.
5 Installation
5.1 Licensee is permitted to install the Fonts on a Computer of a single (1) Designer.
5.2 Licensee may share the Fonts with third-party contractors, freelance designers, or affiliates to be used only on behalf of the Licensee. The third parties are strictly prohibited from using the Fonts on behalf of any party other than the Licensee. The Licensee must ensure that all third parties comply with the terms of this License.
5.3 At all times the Fonts must be sufficiently secured against access and illegal acquisition by public and non-licensed third parties.
5.4 Licensee may install the Fonts on a local area network (LAN) server in Licensee’s ownership to be accessed by .
5.5 Licensee is permitted to make a back-up copy of Fonts for archival purposes. The back-up copy of Fonts is subject to all conditions listed above.
6 Usage
6.1 Permitted uses of the Fonts
6.1.1 Design, presentation, and evaluation of potential uses.
6.1.2 Testing.
6.2 Prohibited uses of the Fonts
6.2.1 Using of Fonts for design and production of commercial printed or digital documents, elements of visual identity, corporate materials, design and production of 3D physical objects, film and video, or any similar output is prohibited under this License. A separate License must be purchased in order to use the Fonts in this manner.
6.2.2 Using of Fonts on websites and web applications is prohibited under this License. A separate License must be purchased in order to use the Fonts in this manner.
6.2.3 Using of Fonts by embedding them into software applications is prohibited under this License. A separate License must be purchased in order to use the Fonts in this manner.
6.2.4 Using of Fonts in online services allowing End Users to create and/or download digital documents is prohibited under this License. A separate License must be purchased in order to use the Fonts in this manner.
6.2.5 Using of Fonts in live-rendered streaming or broadcast graphics is prohibited under this License. A separate License must be purchased in order to use the Fonts in this manner.
6.2.6 Creating specimens or products showing any major portion of the character set of the Fonts for public presentation and access is strictly prohibited without the express consent of the Author.
6.3 Except as may be otherwise expressly permitted by a separate agreement with the Author, the Fonts or their parts cannot be modified, adapted, or reverse engineered by any means. However, the fonts may be converted into vector outlines and these outlines can be modified in graphic applications such as Adobe Illustrator.
6.4 Except as may be otherwise expressly permitted by a separate agreement with the Author, the Fonts and none of their parts can be published, leased, licensed or sold to any third-party person, subject, or organization.
7 Rights
7.1 Licensee agrees that the designs embodied in the Fonts, the trade names, trademarks, and copyrights associated with the Fonts are each the exclusive property of the Author. All rights not expressly granted under this License are reserved to the Author.
7.2 The Fonts are protected by trademark (TM) and pursuant to Author’s Act. If the printed and digital documents in which the Fonts are used contain a section with author information (e.g. colophon), the Licensee is obliged to initiate name of the Fonts, trademark and copyright clause of the Author. Example: Clarinet™ Typeface © Ondrej Jób (setuptype.com).
8 Guarantee
8.1 Fonts will be repaired or replaced only if defective. To make a warranty claim, Licensee must notify the provider from which they obtained the Fonts together with a copy of the Sales Receipt. Guarantee shall not be applied to converted, modified or otherwise changed Fonts. Guarantee does not cover assurance of performance, result or marketability of product using the Fonts nor applicability of the Fonts for particular purpose. The Author is not obliged to compensate for the Fonts or return the paid amount, if the malfunction was caused by accident, abuse or loss of the Fonts as a result of theft, natural disaster, or negligence. The Author is in no event liable for any consequential, indirect, incidental, criminal or other specific damages.
9 Termination of License
9.1 In case any of conditions hereof is broken, the Author is entitled to terminate granted license for usage of the Fonts without any financial compensation. Licensee agrees to immediately discontinue using the Fonts and delete all of the associated files and back-up copies.
10 Miscellaneous
10.1 This License embodies the entire understanding between Author and Licensee and supersedes all prior arrangements or understandings.
10.2 Content of this License shall not be amended or changed in any way. The License shall be governed by the law of Slovak Republic. The approval of contents of the License by the Licensee is expressed through the first usage of the Fonts.

What is a license?
The license grants the licensee the right to use the fonts. The licensee is not the owner of the fonts. The license specifies the terms and conditions of use of the fonts and is a legally binding agreement between the author of the fonts and the licensee.
In the event that the actual use of the fonts exceeds the conditions established at the time of purchase of the license, the licensee is obliged to update the license. -
Who needs to license fonts?
Every person or organization who uses the fonts or documents and products containing the fonts must purchase a license – in most cases this is the client, not the designer.
However, there are particular use cases, when a designer creates a one-off standalone product for a client, e.g. a poster, book cover, or a typographic illustration — in such situations it is the designer, who needs to purchase the license.
